Types of child injury accidents

Making a child injury claim
Child injury claims are slightly different to other types of personal injury claim. This is because a child – meaning someone under the age of 18 – cannot bring a legal action on their own. A parent, relative or legal guardian can bring a claim on a child’s behalf. Or a child can wait until their 18th birthday to start a claim, after which they will have three years to bring a claim.
There are some exceptions to these rules. We can advise you on your exact case when you call.
If damages are paid, your child’s compensation will be held in an account by the court until their 18th birthday.
The money can be accessed before their 18th birthday if your child needs it for something. For example, it can be used to pay for things such as rehabilitation and care costs or something that is needed as a result of the accident. We can also ask for ‘interim payments’ for you, compensation that is paid while the claim is still continuing and before any final sum is paid. This means that you can make sure that your child’s needs are met as the case goes on without being out-of-pocket.
